    Hi,
    I am a naturalized American citizen. My mom, a widower is currently visiting US on visitor visa.

    I would like to file for her Greencard while she is here.

    However, she does not have a Birth Certificate. Never had one or needed in India.

    My bro is arguing that birth certificate is not needed for applying for her green card.

    Is this true? Is her birth certificate not required?

    Should we try to get her birth certificate or its not really not needed?

    I am confused as some people say that they have got RFE's but don't see the requirement for this document in USCIS page.

    Anybody has clear information on whether this is needed or not?

    We could save a year if she does not have to go back to India to get this document.

    Please let me know.

    Of course it's needed. The birth certificate is one of the most important documents in any petition, family-based or otherwise.

      7. A copy of the intending immigrant's birth certificate and/or passport along with English translation. (If in any language other than English) (no longer needed)

      Maybe this document is no longer needed? Anyone applied without birth certificate and was able to get the GC without issues?

      By the way I have my birth certificate. That is not a issue. Only her birth certificate is not available.

        The link is for filing for a spouse outside the US. You are filing for your mother so this is not procedure.
