  • Application Status After Petitioner's Death

    My mom was on Green card when she sponcered my brother , she got passed away after 2 years in Pakistan and one year after her death uscis approved the petition and sent it to Islamabad .
    It's been 3 years now sincee the approval sent to pakistan.
    Question is what do we need to do in order to keep the petition alive, or what to say in the interview if my brother gets interview date .

    In some cases they will deny the application and in a few cases they have approved the application also. If you are in US, you should speak to some attorney who offer free consultation.

      There is still hope. Go to the F3 thread in this forum. It may take you awhile but some one in the F3 thread had the same problem and they got petition re instated and were able to keep it alive.
      I think the persons name is Klast, if I recall correctly. Your brother falls under the F3 category as well. Good luck, and keep us posted.

        Mark 777, your brother is in F2A or F2B (depending on his age). Where was he when your mother died? There is a new law called Survivor Law but is applicable only if the beneficiary was in the US at the time of the petitioner's death. Otherwise he can apply for humanitarian revalidation.
