  • Marriage based Green Card

    Hi,
I'm currently on H1-B visa. My wife is a US citizen. I'm planning on applying for my Green Card but I do have a offer letter from a company who would like to hire me and transfer my H1-B visa. But I can't join till I get my H1-B visa approved from USCIS. They would like me to join them ASAP.
I am thinking of submitting all my documents to USCIS for my green card and letting company know about it. Is it possible for me to join this company on the basis of submitting all documents to USCIS.
    Any advice is highly appreciated.
    Thanks,
    Harry

No, it's not. You will have to get your I-130 approved and have your EAD approved.

Alternatively, you can work for the new employer after they file your H1 and you get the receipt.

      green card

my cousin had the same case and he chose to apply green card through marriae instead of h1b
and later the wife divorced him and he left alone with conditional GC now facing the immigration officer to prove his marriage.

Is it possible for me to file Green Card and at the same time my company filing for my H1B?
Or that consider confusing and complex situation for USCIS- as on one side I'm telling I am going to be a permant immigrant and on other side my company saying non-immigrant worker?
        What should I do?
