Hello all,
I have an approved I140 and my priority date got current recently. My company plans on applying for the I485 soon. I am currently on a H1B visa through my employer.
However, I recently also got married to my long term US citizen girlfriend and we are considering filing a parallel process of I485/I131 based on marriage to US citizen.
I have the following questions,
1. Is this a complicated process and should I just pick one process and ask my employer not to file?
2. On my marriage based I485 part 3 under "Have you ever applied for permanent residence before?", what do I say?
3. How do I present the history of my approved I140 and H1B visa with my marriage based I485?
4. Other than part 3 of the I485 form, is there any other form or information that I need to provide for my marriage based I485?
5. Finally, are there others out there who have been through this situation? If so, can you please share your experience - specifically anything particular to look out for?
