USC file for mother ...confused!!! Pls help!

Hello, everyone

I just started to research the process of green card application for family, and I got very confused!


Any help is greatly appreciated. Here is my situation,

I'm a USC and PhD student. My mother want to live closer to me, so I'm exploring the process to petition for her and her husband. They have been married for almost 10 years, but AFTER my 18th birthday.

My questions are ...

1) Can my step-father immigrate as my mother's derivative, or it has to be a whole different process for him?????

2) I'm still a student. Obviously, it'll be difficult for me to sponsor them. However, my step-father's financial condition is much better (he owns a construction company in home country) then me. Can they sponsor themselves?? What will be the income/ saving/ property requirement for them then?

The thing is, your mother has not gotten a GC yet so i find it impossible for him to be her derivative. She will need to attain her residency before filing for him. You need to consult an immigration attorney on this delicate case.
