  • Adding Spouse to the GC

    Hello,

Iam from India and I got the green card before my marriage. As i cannot add my wife in my status, she came here in F1 visa.
She has just completed her MS and has the OPT status now.

Now , i was planning on adding her in my status , so here comes the following questions..

    1. Iam sure , i have to re-marry her and register the marriage to add her in my status. what is the procedure to get married and registering in US?

    2. Once i get the confirmation for the petition from USCIS, can i add her in my health insurance as spouse?

    3. Would she face any problem at the port of entry(if she visit india) because she got married to GC holder?

any answer to the above questions or any other advice would be greatly appriciated.

    thanks

    1. No need to marry again if the marriage is valid in the place where it was held. Just submit a copy of the marriage contract with the I-130.

    2. Health insurance is not tied up to a petition. Since she's your spouse and is legally in the US on F1 visa you can add her in the health insurance now.

    3. I don't think so as long as her F1 visa is still valid.

      Thanks for your reply.

But my wife is here on F1 visa with 'single' status. We are not leagally married here.
Would you still have the same answers for my 3 questions?
