  • 1-130 expidite help please urgent....

    Hello I filed a petition for my husband and it was accepted on 12-21-11. My husband has since been granted a voluntary departure which he did...We have two children one together and one that he adopted. We have been married for 4yrs this month, we have been together now for 10yrs. I am at a complete loss because without him our kids and myself are suffering tremendoulsy...Our son has ADHD and is on medication, his behavior and grades are starting to drop. He is a gifted child, but is not showing it currently.. He hasbeen tested and everything. Our daughter has asthma and I am severly depressed, I have been on medication for manic depresion for a long time,however it is not working now and they are having to up my meds. I work, but only make $500 a month, he was our main provider without him here we have had to go on every state assistance there is, which we never did before. I cannot even afford to buy the things our children need. He has been unable to get a job in Mexico, so he can't send me anything, not like he really could if he had a job because of the wages..Also we tried to go there and stay, but the conditions just are not what they need to be for the children, they don't even speak the laungage. I don't know what to do or how to even start...cansomeone please help me to figure out how to file an expideted request for an I-130. I am thinking that we need to do it on Humanitarian Reasons...If you need additional information please ask, I am not sure what to do I am lost....please help. I as well as the children are all US citizens and he is from Mexico...

    What's the reason for the voluntary departure of your husband ? When and how did he enter the US ? Was your petition for him already approved? If so it will not take more than a year for a visa to be available bec he is an immediate relative of a US citizen.

    However if there are legal issues, I would advice you to consult a good immigration lawyer to know your options. Sometimes difficult cases would need a personal bill from your congressman. Good luck.

      He was granted voluntary departure upon completion of the bond aggrement. He was picked up by ICE because they were looking for his brother and they had my husband listed as contact for him..He entered illegaly in 2001. No my petition is not approved yet. That is why I am trying to exedite the petition. We do have an attorney but because I filed the petition before obtaining an attorney he has nothing to do with the I-130 only the process after it is approved. What do you mean by a personal bill from my congressman? And thanks for your help

        You can ask the help of your congressman to file a bill in behalf of your husband. Ask your lawyer about it.
