  • Filed I-130 but now the sister is married...Help??

    If we filed I-130 for our sister to come to the U.S. It has been 5 years, now that she is married and has kid. Which form should we use to add her husband and kid on to her I-130 application? Thanks

    Is her petition with USCIS or USCIS has sent it to NVC? First find out what is the status of application (is it at USCIS or at NVC) You don't need any form. Just send a letter stating that your sister's marital status has changed. Send a copy her marriage certificate and copy of her child's birth certificate along with the letter. (make sure that birth certificate has parents name on it, atleast mother's name).

      Thank you for your promptly response, her application is currently at NVC. I will send a letter to NVC stated the status changes. Thanks

        This does not help. Once her priority date is current, the local embassy will contact and then she needs to add her husband and kids. There will be no problem at all and the entire family will get the GC's provided the kids are under the age of 18.

          Incorrect daru786. OP should inform NVC of any change in marital status, address, births, deaths, etc that has an impact on the immigration of beneficiary. Also the children under 21 (not 18) when the visa becomes available will be included in the petition. (CSPA may provide relief for children over 21 y.o. if determined to be eligible)

            Sorry about that, you are correct about the age 21. Rest is not true.
            When you apply for a sibbling, you applied for the sibbling. Any changes can be disclosed and added once the priority date is current and the beneficiary files the papers. Trust me on this one, you are speaking to someone who went through all that.
