  • Affidavit of Support-Currently in US with dependants

    Looking for a little guidance.

A long time friend of mine has been married for a few years to an un-documentated immigrant. I believe she came here on some type of visa many many years ago, which I believe expired some time ago, however she has stayed in the US. The couple have several children, both from prior relationships, and 1 child together, born in the US. The potential immigrant has 1 child over 18 (that I believe is here un-documented), I child under 18 that was born here from a prior partner, and a child born here with her current husband and sponser.

My friend does not meet the support/income requirements to sponser her without a co-sponser. He has asked if I would be willing to be co-sponser in order to start the process for her to get her green-card. I do not know what benefits (food stamps, medicade, etc) the family may currently be receiving.

My question is, if I were to agree to co-sponser this individual, what would I be accepting responsibility for? If they are currently married and receiving some means tested benefits, would I become responsible for those by default due to the fact they are married? Or does it stay strictly with the person sponsered? Or what about any benefits received by the children who were born in the US?

I know thats alot of questions, and any help would be appreciated.

The sponsor will become responsible for the individual till the individual becomes a US citizen. You will be taking financial responsibility.........

      Thanks for your reply.

So would that responsibility extend to any dependants of the individual that are citizens, and may be currently on some type of means-tested benefits, simply due to the fact they are dependants of the sponsered person?

      Thanks again.
