  • GC for my mom

    Hi:

My mom came to US about 6 yrs ago on visitor visa and could not go back and overstayed.
I am a citizen. Can i file for her greencard as she is in USA? What are the steps and processes?

Being a US citizen your Mom is considered Immediate Relative and she is not subject to priority date when it comes to process her application, on contrary the USCIS will process her application much much faster compared to your brother and sister for example. All in all that will take like 10 to 12 months to get approved and obtain her Green Card. What you need to do is to file I-130 and I-485 simultaneously for her. You will also need to submit along, your birth certificate, a copy of your passport/naturalization certificate and may be an affidavit of support form I-864 as well . I also advise you to ask an immigration attorney for may be better advice.Good Luck

Also note that the only way she can get a green card is inside US.
If she leaves US before she gets her green card, she will not be able to enter again for 10 years
( 10 year bar for overstatying)

If I may advise I would say go ahead and file I-130 & I-485 right away. Good Luck.
