Hello, I have a good friend that is from Guyana (South America). She was engaged to her Haitian American husband and came to the USA with her son on a fiancee visa. They then got married here and she has her temp green card. She is now working legally and going to school. Her husband has started mentally and emotionally abusing her for the past several months. She has only been here for about 8 months. The marriage was in good faith, but now he has become a totally different person. He takes away the car from her, so she has no transportation for school/work. He is in bankruptcy (which she did not know that he was in a financial situation when she married him). She gives money for the bills and he withdraws it to spend. It's like, he was Price Charming when she was still in Guyana, but when she came to the US, he turned the devil. He preaches about GOD, but yet he is NASTY, etc.....
As a good friend, I do not want to see her go through this, but she said he would divorce her and report her to immigration. I would prefer her to go back to Guyana than stay with him and take allllll that abuse! She and her 13 yr old son does not deserve it.
Eventhough it's only been 8 months, can she leave him?? She has family in another state that she can stay with. If she leaves him, what will happen to her status (green card), etc? What if she does not have a lot of proof of his abuse, since it's more mental and not physical? I know she can leave him and get a waiver. What does that waiver do and how long does it take? Will that waiver "protect her and her son" from him? Also, will her husband need to get "involved"? She is afraid that if he gets involved, he will spite her bad and say things that are true that can go against her. I have personally met her husband. He is a complete ****!
