  • Processing time for GC - Marriage on GC or USC ?

    I am Greencard holder(eligible to apply for my Citizenship in another 2 months) planning to marry my fiancée who is on F1 visa. We are planning to get married in USA, get my fiancée greencard and then would like to go to India for marriage ceremony. Would like to know which process will take less processing time to get her greencard so that we can go to India for ceremony as early as possible?

    1. To get married when I am in greencard status and apply I-130 in F2A category and then when I become USC, upgrade it to IR-1 category & apply I-485.
    2. To get married when I become USC then directly apply the I-130 in IR-1 category as well as I-485 together?

    Can we go to India for ceremony any earlier than my fiancée gets her GC ?

    You can do it either way. Timings vary all the time for either of them.

    She can go to India at any time, but in order to return, she either needs valid F1 visa (with intention to study after coming here) or advance parole based on I-485.
