  • Which one is better - GC through wife or the son?

    My dad used to have GC and surrendered it a few years ago. He received a 10-year multiple entry tourist visa in return. Currently, both my mother and I are US citizens and could technically file a petition for my dad's GC. My mom-dad lives in India while I live in US. Both of them have valid visas (US citizenship and tourist visa) to visit US. Now, my dad is ready to get his GC back and I am in the process of doing the paper work for him. I need help with below questions:

    - Is it better if I file for him or my mom?
    - Does it make any difference if he is here in US when the application is filed?
    - My mom always lived with my dad in India, even after the citizenship, and she may not have enough financial strength to sponsor him. Is it still okay to file through her?

    Please help.

    As your mother lives in India and you live in the U.S., you need to file for your father's greencard.

    If he is visiting the U.S. with the intention of filing the green crad, that is not allowed. If he later changes his mind, that is OK.

    In additional to finances, the sponsor needs the residency in the U.S. too. Therefore, you mother should not sponsor your father.
