Request for initil evidence (i-485) -birth certificate

  • Request for initil evidence (i-485) -birth certificate

    I have filed I-485 for my mother. She doesnt have birth certificate as that time it was not mandatory to register it. But I produced secondary evidence as affidavits from 2 person along with non-registration-certificate from local government body (municipality). I received a RFE as below :
    you have submitted secondary evidence birth affidavit as proof of your birth record, however the evidence you have submitted is insufficient.

    In addition to birth affidavit or secondary evidence, per title 8 code of federal regulations sections 103.2(b)(2)(ii) you must submit "an original written statement on government letter head establishing this from the relevent government or other authority. The statement must indicate the reason does not exist, and indicate whether similar records for the tie and place are available"

    -- I had given the copy of the letter from municipality saying that "certified that on verification of muncipal birth and death records, the borth of xxxxxxx occured on 11/11/11 is not seen registered" with sign and seal.

    I have a copy of this. does that mean i need to give original letter to them ? does anybody have similar experience ???

        From what country are you? If your country has a National Statistics Office or National Civil Registry Office (not local or municipal registry) you should get the certification of non-registry there then send this original certification to NVC. If you have other secondary evidence like school records or baptismal records showing the name of your mother submit also a copy.

            As per USCIS requirement ,original letter for Non availability/non issue of birth certificate for people born before 1970 is required to be submitted .If the certificate is other than English certified translated copy is also required. After satisfying with the documents clearance will be given by USCIS for further processing.
            As regards Original document on Birth certificate submitted as RFE, You can get back when Green card/Visa is granted by USCIS on application for Return of Documents .Application need to be sent to the place from where Green card./Visa is issued. This is easy and straight method to obtain clearance on RFE for Birth certificate querries.Hope this solves the issue.
