  • F4- Brother and Sister Visa

    Hello,

My Aunt had filed for an immigration visa for her brothers in 2002. Can the sons/daughters of the brothers who are age of 25 or 25+ benefited i.e. do they get to come to US with their family.

Thanks a lot in advance for the replies/suggestions.

If your Aunt's grandkids at the interview are unmarried and 21 years old *after* CSPA calculation then yes they should recieve a visa too. If one of those grandkids marry after they get the visa but before they enter the US then they are up for deportation if ICE (immigration police) finds out.

When did your aunt file (exact date)?
When was the I-130 form approved?

No. There is no category for extended family like nephews, nieces, grandchildren, etc. Your uncle can apply for your mom but you are over 21yo so you cannot be included as derivative beneficiary. You can enlist in the US military. This is the fastest way towards citizenship.
