I am in my 6th year on H1B visa. My 6 years will complete in July 2013. My employer has initiated my GC recently and I have submitted all my documents to attorney. Prevailing wage request was submitted in last week of January 2013.
I understand that my 9089 labor cert and I-140 approval may not complete by July 2013 as my GC will be in EB2 category.
My query is, once I leave USA before completion of 6 years, what is the process after 9089 labor cert and I-140 approval. Do I need to apply for a new H1B visa which means that I may have to wait for 2014 quota.
What are my options?
