Hi. I am from the Philippines. My family and I entered the U.S. in June 2005 on a tourist visa. My employer has recently filed a labor certification (under PERM) and assuming that this would be approved by November or before December 17 (our 6-months stay would expire on Dec 17, 2005), we would file an I-140 (and I-485 if posible). My questions are:
1. Since EB3 has retrogressed for the Philippines, what are my options if there are still no priority dates available by December 17?
2. If the priority date becomes available after my I-94 gets out of status (for not more than 180 days), can I still file for an I-485?
