Do I fall under H1B Cap Exempt, Please Reply Very Urgent.
Hi All,
I have been in US since July2006 - Jan 2013, my 60 months period is finished.
My employer applied for my Green card and my I-140 got approved in FEB, 2012. My PD is FEB, 2011.
In DEC 2012 my H1 extension got rejected and I left the US in JAN 2013.
My employer did not revoke I-140.
NOW, DEC 2013 Another employer is willing to sponsor H1B but he asked me whether my I-140 is valid or not.
If it is valid then I fall under H1B cap exempt.
I have asked my previous employer about the validity period but they simply said there is not valid period for I-140.
My questions
1) How to find my I-140 validity period?
2) Do I fall under H1B cap exempt?
3) Can I do H1B Transfer now after 1.10 yrs of my I-140 approval?
Please kindly answer, this is very very important for me.
