Would appreciate an answer for the below:
I am currently working on an H1B for Company B who has applied PERM in Dec, 2013, My Present H1B is valid till June 2014, My PERM for Company B based on current PERM dates might not be approved by June.
I have a copy of my I140 from my previous company, Company A which I had used for transferring to Company B, it was approved at the time of transfer , but has since been revoked after leaving the company, It was in approved state from May 2011 till Nov 2013, it now says revoked though on the USCIS website.
My Question is: In case Labor and I140 are not done for Company B by June (Which is a major possibility), can I use the the now-revoked I 140 from Company A(which was once in an approved status, whose copy I have) for extension on H1B, also for porting priority dates once Company B’s I140 is approved?.
