I was in the US from Oct 2000 till May 2007 on H1B Visa. While I was there, I had started my GC process via my employer and got the I-140 approved in 2005. I also got my H1 renewed for 3 years (since my I-140 was approved) in 2006 - till Oct 2009. However I returned back to India for good, due to personal reasons in May 2007. Hence my H1 from June 2007 till Oct 2009 was unused and I also had an approved I -140
My question is - can I go back to US now and what would be the best way to do it? Can I get exemption from CAP because I have more than two years left on my last H1 extension and based on old I-140 priority date?
Please clarify/suggest.
