I have a question with regard to job switch once my I-140 is approved.
Below is my situation:
Current H1 valid till Dec.
6 years finishing in Jan.
Current employer has filed I-140 and we are expecting decision in next 10 days (premium).
My client has offered me a full time position and my current employer and client are in good understanding about this.
Two of my main concerns are:
1. Getting 3 years extension on my H1 - since my I140 would be approved in 10 days.
2. Keeping my priority date.
I need to know what path should we go around to make sure both of the above requirements are met:
1. Once I get my I-140 approval, should my current employer first file for my H1 extension? Once I have the the 3 year extension then should my new company request for H1 transfer?
2. Once I get my I-140 approval, can my new employer directly request H1 transfer and can get 3 year extension?
Since I am joining the new company after my I-140 approval, would I be able to keep my priority date? I understand that the new company would need to file the PERM again.
