I have question regarding Maxout on H1B, I have following question. I would appreciate if you could please help with any inputs.
1) I would be at H1B Maxout in June2016, completing 6 years. With company A, I had I140 approved under EB3 and the priority date is established.
2) Last year, I changed employer and now working with company B and they filled PERM under EB2. Waiting for decision on PERM approval.
Now, if I change the employer and join some full-time position then without approval of PERM from company B, Can I extend my visa with Company C after MaxOut?
In other words, based upon previous approval of I140, Can I extend visa even without having PERM approval from petitioner?
Or should I have to wait till PERM, from company B gets approved, get I140 approved and then after ONLY change to full-time with company C?
Also, Is it safe to assume that my priority date would remain even if I140 employer withdraw I140 application /approval?
