  • I-140 RFE - doesn't establish that beneficiary is qualified

    Hi,

I have received an RFE on I-140 stating following

"You have submitted a Provisional Certificate of a degree Of Bachelor of Engineering.
This is not evidence that the actual degree has been conferred. Submit additional document, this evidence must be in the form of an official record from the institution showing the dates of attendance, area of study and date of degree award"

We are working on getting original degree from the university - degree has Area of Study, Examination of 2006, Degree Conferred by senate on 7/17/2015

    Questions.

    1. I completed my course in 2006 but we did not request for the degree till now, thus degree was awarded now, will above information establish the fact that she qualifies as 2006 awardee?

    2. It does not include the date of attendance, should we request for another letter from university or college for date of attendance or degree is enough?

    3. Any suggestions on if we should get any other documentation?

    Thanks,
    pada

This is complicated. Since, you must have had the degree before you began working for the current employer. Your employer's lawyer should be careful in responding. Also obtain official transcripts showing dates of attendance.
This is my opinion and not legal advice.
