I am an H1B employee whose visa extension was approved on Feb 2016 and expires on Feb 2019 and my green card process is at i-140 stage. I WAS LET GO TODAY.
My initial first ever H1b was approved on Feb 2011.
I was informed that should I decide to leave the country and go back home (India) and if I decide to come back to the US later (like after 2 or 3 years) on H1B then I don't have to go through the lottery again and that my priority date will not change should a new employer apply for my GC again. Is this true?
My employer will be revoking the H1B but said will NOT be revoking the I-140 petition even though I got fired. Please help! Thanks.
