After 2 years or I-140 processing by USCIS, I received RFE and they have asked questions on everything possible. Now my employer is insisting that I should start with New PERM instead of replying to RFE because it has hit rock bottom and there is no way we can reverse the result.
Note : h1b expiring July 27th 2017
6 years of H1b completing in December 2017
These days after prevailing wages and placing an AD can take upto 6 months before the PERM is filed.
Options:
1. Reply to RFE and start new PERM process with new position in the company? So new Perm can be filed in Jan-Feb 2017 and hoping it takes 10 months to clear PERM and I-140, I can stay in US.
2. Leave this company( maybe bad rep with USCIS so I-140 with RFE) and join the prime vendor of the client who can start the process after H1b transfer? But will delay the process another 2 months or so.
Any suggestions are welcome.
