  • Going out of country after I-140 approval

    I have my I-140 approved recently. Since it takes 3-4 years to go to next level, can i go out of country and be back in 2-3 years time. Will my approved I-140 be in effect or will it get invalidated?


    Please advise.

    Your I140 has got nothing to do with your travel. It will remain valid unless USCIS revokes it for fraud or your employer withdraws it. Recent regulation dictates that it will be cancelled if the employer withdraws within the first 6 months after approval. Beyond that, your I140 PD stays with you, even if your employer decides to withdraw the petition.
