    Hi All,
    Can any one help with my situation? Thanks for your help in advance. Here are my case details. My labor is approved and applied for I-140 premium process. Got RFE and employer is trying to submit proof of financial avidence.
    What happens to my legal status if they rejects my I-140? what is my approved labor certificate status going to be? Can I take my approved labor certificate from my employer,go with another employer and file I-140 again? is it possible, if not what are my other options going to be? Let me know.

    Hi Satya,
    After submitting the response to RFE, if everything went well and your I-140 gets approved,there wouldn't be any issues. I wish you all the best.
    If your I-140 gets rejected by INS, you have two choices. You have to change employer and apply again for labor because you can't take your approved labor and go with new employer. Your new employer has to start the whole green card process again for you.
    Second is apply H1 for your spouse with old employer to save your labor.
