Hi, my friend has a situation whose I-140 has been approved since 1 year. Yesterday we got a news that all the Priority dates will be current in July 2007. He was in the process of transitioning to a new company and his papers are with lawyers to file for H1-B extension for 3 years based on his approved I-140 and PD of JAN-2004 as per June Visa bulletin (Please note that you can only get 3 year extension when your PD is not current).
Question : Is he still entitled to get 3 year extension if his papers are filed before July starts, i.e. in June wherein his PD is not current. OR he's going to get one year extension?
