    Hello

    I have a quick question. I am applying for Substitute Labor/140/485/EAD/AP on EB3 in anticipation of taking advantage of the numbers being Current.

    My question is if my 140 is not approved before the USCIS exhausts all the numbers, then I am stuck in retrogession even though I have applied concurrently? To make it clear, let's say that my application reaches USCIS on July 2nd and the USCIS exhausts all the numbers on say July 20th. If my 140 is not approved before July 20th, then my case will be rertrogessed?

    I140 does not come under retrogression term. Only I485 depends on retrogression. So, your I140 will be still in progress & approved depending on how fast USCIS works on your case, while I485 will be processed or approved only when the PD becomes current.
