Hi all, my EB3 PERM labor was recently approved and the receipt is on its way, priority date 09/05/07. My current H1B expires Jan 29 of 2008. The problem I have is do I have enough time to get my I-140 approved? I wish the premium processing was available but its currently not. My lawyer also said that we might be able to extend my current H1 by the amount of time I was outside of USA. So I am planning to take 1 month off this Dec. I am hoping to extend my H1 by maybe two months including this 1 month and some other vacation since early 2002 by a total of about 2 months. My questions are:
1) Do I have enough time for getting it approved?
2) Would I have any issues during re entry? I have a valid H1 VISA till end of Jan, but it has not been 365 days since my priority date, would it cause any problems?
3) Is it possible to at least keep extending my H1 by 1 year?
4) What happens if my I-140 is not approved by the end of my extended H1?
Lot of questions, any help is greatly appreciated.
