  • I-140 pending, PD current

    My Priority date is current. However, my I-140 is still pending.

    Can I-140 be premium processed since PD is current? or do I have to wait for I-140 to be processed before filing I-485

    You can file 485 concurrently.

      Thanks..

      Since my PD is current can I apply for consular processing or do I have to wait for I-140 to be approved before that?

      I mean will consular processing help me at this stage considering I-140 is pending or considering the I-140 backlog, consular processing will not be any faster.

      Could you kindly advise if I-485 a better route or consular processing at this case for a faster GC.

        How was your I140 applied? As CP? CP is faster than AoS but comes with its own risks. Talk to your attorney. If I were you, I would go with Aos if you have a dependent that could use EAD.

          My I-140 was originally filed as regular (not CP). But considering that the PD is now current can I get go through consular processing for the rest of the process (including I-140)?

          I am concered that the numbers will retorgress again and now I can use the current PD oppurtunity to get my GC faster. Is that an avilable option?

            You need the I140 approved before they call you for a CP interview.
