Filing for 1-140 when employer is going thru Chapter 11?
I recently received my labor certification, but currently am in a position that my company due to some financial tangles had to file for Chap. 11 reorganization.
I am currently billable and also on a project. For me to apply for I-140 and 485 the lawyer things that it may not be a good idea since the companies financials are not good at this point.
Has any one come across a situation that if I apply for 1-40 and 485 together under similar circumstances ? has INS rejected or accepted through the initial review of I-140 (since 485/EAD is also applied together)
I am in a delicate situation now, appreciate if you'll can post any experiences.
