I-140 withdraw and H1B expires

My company applied GC last year July by using substitute labor and I-140 concurrent. Now there was a I-140 RFP and the company responded to withdraw the GC case. As USCIS will take minimum 60 days to respond, is it legal to apply H1B 8th year visa extension in premium process? My current visa is going to expire in 17th Dec 2008. Please help me!!!!!!!!!

Why did your company decide to withdraw?

Are you still working for them?

If not, have you applied for a new labor/I-140 app with your new employer?
