I am on H1-B visa with approved I-140 under EB-2. I have to go back to India for family emergency. I may not come back soon. I have following questions:
1. Can i come back on same H1-B (valid I-797 till Oct 2012) for same employer in future despite taking some months off the work? I will not be on the payroll during this off time.
2. If i dont come back, can i get my GC application converted to Consular processing and get my GC whenever my priority date becomes current through consular processing in india?
