Can i apply for I-140 if i am not working with that company yet

HI

I have a question/confusion

I am on H1b with company AAA and H1b expires in Sept 2011
Company AAA has a sister concern company BBB
and they filed my Labor through company BBB

it got approved in EB2

My questions is :

I am still working for Co. AAA can i apply my I-140 through Co. BBB.
or do i need to tranfer my H1 to Co. BBB first ???
