    Hi All,
    • I have an approved I-140 for Employer A.
    • I recently changed jobs, have an approved H1-B with the new employer B. The H1-B is valid for about 22 months
    • I have initiated the PERM transfer process.
    Question:
    If the PERM approval with new employer takes more than 22 months, can I still file an H1-B extension since my I-140 was approved with the last employer ? OR
    Do I need to go back to home country if PERM approval does not come through in 22 months ?

    Answer: Yes. But, your I-140 Approval must be crossed 180 days...
    OR
    Question: Do I need to go back to home country if PERM approval does not come through in 22 months ?
    Answer: As i mentioned, if your I-140 Approval crossed 180 days, you can extend your H1B with the help of that.. No need to leave the country..
