My L1B visa extension has received an RFE and the processing of RFE will exceed my I-94 extension date. I plan to come back to USA after a couple of years in L1A category in case there is a denial of L1B visa extension.
I want to understand if there will be any issues on green card processing if my L1B visa extension gets denied (since my stay after I-94 expiry) is counted as out of status, I currently have an eb-3 I-140 approved and plan to upgrade it to EB-1 once I come back. Can some one help answering the green card question, I am considering leaving the country before my I-94 expires so that I don't have any issues in processing EB1 green card when I come back.
