  • Question regarding I-140 RFE

    My I-140 EB2 was filed in premium and it received an RFE from USCIS related to a specific technical skill. They specifically want documentation of where I obtained experience with that skill, which was listed as an additional necessary skill required for the job on the PERM form.

    I gained this experience while I worked for a startup company in the bay area for 2 months in 2015 and since the company ran out of funding, I resigned.

    I and my current employer have tried contacting the employer to get a letter stating that I have got experience in that skill but the employer never responds. So I have got an email confirmation from a former employee (who worked as a consultant) of the same company who remotely managed me stating that I worked on that specific skill. The letter has his mailing address and phone number. The former employee won't be able to help much on this. I also have an Onboarding word document that was used for me when I was hired. That document has listed that skill.

    Is the above documentation going to be enough to respond to the RFE? There's nothing more we can do I think since my startup employer isn't responding to our requests. My employer is also planning to include PDFs of emails that I attempted to contact the employer and never got a response.I believe my employer will also include the PDF of their attempt to contact the employer without any response from my previous employer.

    Hi,
    Always Employment letter will be strong enough to proof that you gained knowledge on the specific skill. But we have secondary set of documents to proof for the same such as, Offer and Appointment letters, Affidavit from your Supervisors, Affidavit from colleagues..
    As you mentioned you have gathered Email confirmation from a former Employee of concern company, you will also proof that, he was employed with concern company during that period. For this, you will need to get Offer letter and paystubs from him for covering that period.
    Additionally, try to get any supporting evidence showing your previous Employer was not in the business right now.

      Thanks. My I-140 got approved within 7 days after submitting the response with the documents I mentioned in the original post.
