  • Job switch after i-140 approved

    Hi,

My i-140 was approved 1.5 year back. Current visa (extended beyond 6 years based on i-140) is till June 2023. If i switch job, i understand that the new company need to file the PERM and i-140. So does it need to be completed by June 2023 (in my case) to enable me for further visa extension? Or can the visa extension be based on my old employer's 1-140?

    thanks
    SB

      Hi,
Hope you are on H1B Status. If so, Yes. You can extend your H1B status beyond six years with any Employer with the help of previously approved I-140 petition. It does not require that, Your current Employer have to file I-140 petition again to extend H1B.\
Please note, your previous I-140 should not be withdrawn by petitioning Employer within 180 days of I-140 filing.
      Thanks
