I got my Perm approved under EB3 category last August and subsequently filed for I140 under premium processing. I have a B.E degree from India (4 year course) + 10 yrs experience. Due to some reason my case was filed under EB3. Now in my I140 form, the attorney selected checkbox "professions holding an advanced degree or an alien of exceptional ability" and hence my I140 got denied from USCIS. I would like to understand if this selection was appropriate for my EB3 case.
Later we refiled my I140 under skilled labor. My attorney says USCIS has recently changed the rule for I140 selection of category and hence the difference in opinion.
