Approved I-140 (more than 4 year) Come back to USA with H1B Excempt

I have stayed in US for 9 years in H1B visa with approved I-140 (4 year),
Planning to move to India with different employer, after 3-4 years plan to come back (assume PD not current that time).
Shal I able use H1B cap except (no lottery) with approved I-140 file H1B petition and come back with different employer?.
