I have priority date of Sep' 2009 EB2 category.
I have my I-140 approved and H1B extended for 3 years (expiring in Sep 2012)
Can I temporarily move to India and work remotely from there. Once the priority date becomes current, I can come back to US so that employer can file I-485.
1. Do you think, this is a legal procedure or will I have issues re-entering US before Sep 2012 for any reason?
2. Also, what needs to be done at this stage for Consular Processing ?
3. After Sep 2012, do I have to wait till my Priority date becomes current to re-enter US ?
