    I am going to apply for my I-140 this week with USCIS (got my eb2 labor approved last week). I have a H1 B work permit valid until Next year Dec. I am planning to go for a vacation to India in Feb - March 2012. I need to go for a stamping since visa is expired. Is it advisable to go for a stamping with a 140 pending.

    if yes. Do I need to tell anything to the consulate office on my I140 process?

    Hi,

    Currently, the situation in India is very different, people who went to India for stamping are facing issues like rejections and 221(g). I would suggest you rethink your decision of going to India for stamping.

    There is no connection between your I140 and your H1B. So, even if your I140 is pending you can travel. I140 will come into picture when you are at the end of 6years h1b completion and you need your I140 to be approved in case if you have apply for extension.

    Let me know if you have completed 6years on H1b or not?
