  • I-140 filed but visa now in AP

    My husband's company filed I-140 in October under EB1-C category. But there may be a problem now and could use some advice.
    We left the USA to have Christmas with family in UK and as we are on L1 status, we went to the embassy to get new visas. The officer issued us a 221g form and kept our passports.
    We were told it is not a problem to travel outside the USA while I-140 is pending. But what happens now? Will the I-140 petiton be cancelled because our visas are in administrative processing?

    don't worry the I-140 will continue independently...just apprise your GC lawyer of the AP & if there is any action needed he will do the needful

      Thank you. Will the I-140 continue even if our visas are denied?

        yes...green card processing is technically for future employment so you should be fine
