I request you to help me in getting suggestion regarding my RFE question, even though I got a perfect Bachelor's degree in engineering, still I need to show all my every year memorandum's which were issued by the university? Is there any one had this same kind of situation at the I-140 status.
Below is the RFE question from USCIS:-
The service knowledges the beneficiary’s educational credentials and the submitted educational evaluation. However , the submitted evidence is insufficient to demonstrate the beneficiary’s fulfillment of the educational requirments found within blocks 14 and 15 of the ETA-750, Part A.Specfically, Part 14 indicates the prospective employee must possess an U.S.Bachelor’s degree in computer science, engineering mathmatics, or a related field. Part 15 indicates that a “Bachelors degree equivalent” is also acceptable.
The verbiage “Bachelor’s degree or equivalent” is interpreted by the Service to mean an U.S.Bachelor’s degree or a single-source, foreign degree that is equivalent to an U.S. baccalaureate degree. UnlikeH-1Bcriterion, the aforementioned verbiage does NOT include a combination of education, training and experience that has been found to be equivalent to an U.S.baccualaureate degree.
There is a problem in the transcripts which were submitted and upon which the evalutor apparently based his conclusion. The report exams taken for various years of school indicate that the fourth years exams taken in 1996. The 1st, 2nd and 3rd years exams were all taken in july of 1997. Evidence of education must be in the form of an official record showing the dates of attendence , area of cencentration of study, and date of degree award, if any. Absent unusual circumstance, 4 years of schooling is required. The record as it stands appears to show only 2 years of attendence.
Please submit evidence that the beneficiary possesses, at a minium, an United States Bachelor’s degree in Computer Science, engineering, mathematics, or a related field, OR, a single-source, foreign degree that is equivalent to an United States bacculaureate degree.
