  • H1 to L2 transfer - Change of status

    Hi I am currently having H1 with ym employer and my husband is on L1. I will be resigning my job in next 2 days and I would like to apply for COS for L2 and stay back.

    Is it possible for me to apply for COS ( change of status) at such a short notice and stay in US legally?


    Also, Once I apply COS and the get a job oppurtunity before my I94 expires and the employer is ready to sponsor H1, is it possible to cancel the L2 application and go for H1 transfer?

    You must file change of status form I-539 before your last day at work. It can be electronically filed to ensure that receipt date is before your last day at work.

    If another employer wants to sponsor you while I-539 is pending, they can file a petition for you, but it will be dependent on the COS decision. So, it will not be approved with change of status until change of status to L2 gets approved. It can take 2 to 3 months for that.
