  • US Case Status

    Hi,

I found this forum helpful and I am hoping that someone can help me here.

I had received this status from USCIS:

    "Post Decision Activity

On April 17, 2012, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations."

Until now I dont have any update after that approval. What should I do next? It has been 2 years now.
    Thanks,
    --bretta--

If you are petitioning your relative and he/she is living abroad, your mistake was in waiting so long for correspondence from the National Visa Center. Call the NVC at: (603) 334-0700, give them the receipt number from the I-130 acceptance documents, and ask them if there is any record of it being received by the NVC.

In my opinion, however, if your I-130 was for a relative with Immediate Priority, your approved petition has expired, and you may have to start the paperwork over.

On the other hand, if you submitted the I-130 petition for a relative in the U.S., and there has been no followup approval notice from USCIS, you can also consider this to have expired.

      Thanks for the reply.

But may I ask how does an approved petition expires?
      Thanks,

A petition approval is only good for a specified period of time. For "immediate priority" relationships (parents, spouses or minor children of U.S. citizens), the approval life may be a year from approval if not acted on within that time.

If your petition has been approved and moved on to the National Visa Center, and you have heard nothing in 4 months, you need to call the NVC and ask status of your petition. Call at: (603) 334-0700 and be prepared to give them the USCIS receipt number and birthdates of you and your wife to confirm identity.

                Nearoy,

You need to call very early so as to catch an operator at start of business day, Eastern time. You can also email the NVC .

Please work on your spelling and proper use of English. This is not texting.

Lately, it's been taking the NVC about 10 days to respond to email messages (properly formatted). What you should try to get are
                    1. The State Department case number now assigned to your petition.
                    2. Some indication of when you can expect the fee bill and online payment instructions.

If you succeed in reaching someone at the NVC by phone, they can confirm the new case number immediately.

Until about 18 months ago one was able to get this information through their automated phone system, which has since been discontinued.

If you only submitted documents on Friday (last Friday),

If you reach the live NVC operator, ask for the State Department case number, but you'll have to provide the USCIS receipt number, names of beneficiary and petitioner and birthdates of each.

If you already paid the $88 AOS fee to the NVC, online, then you already have the State Department case number, so there is no reason to call the NVC. You now need to send your sponsorship documents to the NVC.
