  • How long is the entire process from i-130 petition being accepted to visa in hand?

    Hello all! Needing some answers…

I am a US citizen who just sent in the i-130 petition to USCIS for my husband.

A little background info… we met in London (he is British) in March 2014 while I was doing an internship. We got married in August 2014 and the i-130 was accepted by USCIS on September 8, 2014.

    Here are my questions…

    1. How long should I expect it to take from here on out? As in, when will my husband be able to legally enter the US with his visa (considering everything goes "smoothly" and is approved, has interview, etc.)? I know that times vary from case to case, but anyone with a similar situation who can offer there own processing time would be great.

    2. I am a 23 year old recent college grad who will most likely be going to grad school next fall, so I am not sure if i will have a steady job until then. If I am unemployed when I have to send the affidavit of support to the NVC, can I have my mother (who is part of my household) be my sponsor? Does that mean that we BOTH have to fill out an i-864, OR do I fill out the i-864 and she fills out the i-864A?

    3. Lets say the entire process takes longer than we want it to… can my husband quit his job in London, come to the US as a tourist, and stay with me until his interview at the consulate in London? (in which case I would buy his ticket back to London)

Any answers would be greatly appreciated. We have done a TON of research on his whole process for a good two months, but considering there is just so much to this entire process, some clarification would be amazing.

    Thank you!

    ABOUT 8-11 MONTHS.

YOU MUST BE THE PRIMARY SPONSOR, AND YOUR MOM CAN BE EITHER A HOUSEHOLD CO-SPONSOR (USING i-864A IF AT SAME ADDRESS) OR USE THE I-864 AS AN 'INDEPENDENT' CO-SPONSOR.

SINCE HE IS MARRIED TO YOU, THE U.S. EMBASSY MAY BE RELUCTANT TO GIVE HIM A VISITOR VISA, SINCE HE WILL BE PERCEIVED AS WANTING A VISITOR VISA TO REMAIN IN THE U.S. WHILE BEING PROCESSED IN THE U.S. IF HE DOES GET A VISITOR VISA, HOWEVER, YOU MAY DECIDE TO COMPLETE HIS GREEN CARD PROCESSING HER WITHOUT HIS RETURNING TO THE U.K.
