Waiting for I-130 approval...My husband visiting US for my delivery... (F2A)

    My PD is Feb 2014...My husband is in UK in a student visa..He has a visiting visa to US..He will be visiting US for my baby's delivery in DECEMBER.. He will stay with me in US for 3 -4 months and then move to his native country
    (Not to UK)....
    Question : Hopefully within this gap my I -130 will be approved. .. So if the NVC asks a police report for him, from which country do I have to get it?? UK or Native Country???
    Is it safe for him to come here while I -130 is on process??? Will it be affected??

    If being processed for an immigrant visa abroad, your husband will have to provide police clearances for any country in which he has lived or worked for at least 6 months, unless clearances are not accepted from that country or unavailable to him (some countries won't issue clearances to non-citizens once they leave that country).

    Given a preexisting I-130, your husband could be barred entry with a visitor visa once they are aware he is married to a U.S. citizen and has a petition in process mode.

      My husband got his visiting visa after I (permanent resident) applied the I-130 for him.

      During the interview for his visiting visa in UK, he told the officer ( the officer who interviewed) that he is in the process of I-130....Still after knowing about this, the visa was issued...
      So will he be barred during the entry to US???
      He has no intention of overstaying...

        A bar from entry because of a preexisting immigrant visa is not a certain consequence. But it is a risk.
