  • Affidavit of support

My mother (petitioner) sponsored her brother (principal applicant) about 12 years ago; she is now required to submit an i-864. However my mother has always been a housewife and has never been employed. My father who retired last year has always filed a joint tax return with my mother. My mother will be using me as a joint sponsor. I understand that regardless of my mother’s employment status, she is required to file an i-864 for her brother. Since my parents are not currently employed they will be using solely my income to sponsor my uncle and his family. My income is well above the poverty guideline for sponsoring a family of 3 (uncle+aunt** child) and since I don’t live in the same household as my mother I will be filing an i-864 as well. I have a few questions regarding this.
    1. Form i-864 part 3 question 1--> does my mother check of yes or no
    2. Part 3 question # 2--> does my mother check this box also regardless of the fact that she is unemployed
    3. Part 3 # 7-->does my mother write one, even though she is not employed
    4. Part 3 question #1--> do I also check that, since my mother is not employed and is using my income to sponsor everyone or does that get

    Thanks in advance

    MOM CHECKS 'YES'

    2. Part 3 question # 2--> does my mother check this box also regardless of the fact that she is unemployed

MOM LEAVES #2 BOX ALONE UNLESS BROTHER HAS DERIVATIVE FAMILY MEMBERS COMING AT SAME TIME.

    3. Part 3 # 7-->does my mother write one, even though she is not employed

YES, MOM STILL INPUTS A NUMBER FOR #7 (1 IF ONLY ONE APPLICANT)

    4. Part 3 question #1--> do I also check that, since my mother is not employed and is using my income to sponsor everyone or does that get

ON YOUR SEPARATE I-864, YOU DO CHECK "YES"

    Thanks in advance

Thank you soo much Rayb for a prompt response.

I am still slightly confused about two other things.
      1. If my mother and I both Check off part 3 ques 1 does that mean we both will also have to write "1" in part 3 question 7 (meaning we will both end up having the principal applicant added to our "household size")
      2. Yes, the petitioner does have family emigrating at the same time as him, and so in that case both the petitioner(my mother) and the joint-sponsor (I) will write the names of the family members in part 3 question 2 (a-c, to list family member names). And I have the same question for the family members emigrating with the principal applicant. Do I (joint-sponsor) and the petitioner BOTH write the total number of immigrants we are sponsoring (part 3 question 7)

        Art,

Since you are now reporting that there will be derivative family members, my advice will change somewhat.

The information about the additional family members (derivative of brother) should be included on both your mom's primary I-864 and on your I-864, and should be counted in each of your household counts so that NVC reviewers can calculate the amount of income required for your individual households.

Even though mom includes all the applicants on her I-864, it is only because she is required to file an I-864, even without sufficient income to sponsor.

Do you think given the scenario, my father would have to file an I-864a

If you are a separate joint sponsor using I-864 because your mother, the petitioner, has insufficient income to meet the sponsorship requriements, there is no need for your father to be an I-864A household member co-sponsor (if his income will not meet the sponsorship requirements).
